Terms and Conditions

1. Who we are. The Services are operated by Apex Byte Technologies LLC.

2. Who you are. "You" means the person using the Services. If you use the Services on behalf of an entity, you represent you have authority to bind that entity and "you" includes that entity.

3. What we provide. The Services include AI-powered photo editing, enhancement, transformation, generation, and related tools, plus any add-ons or premium features.

4. Eligibility. You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you are under 18 (or age of majority), you may use the Services only with permission of a parent/legal guardian who accepts this Agreement.

5. Changes. We may modify this Agreement at any time. The "Last Updated" date will change. If changes are material, we will provide notice as required by law (e.g., in-app notice). Your continued use after changes means you accept the updated Agreement.

1. Transactions. Some features require payment ("Transactions"). When you complete a Transaction, you authorize us (and/or our payment processors) to charge your selected payment method.

2. Taxes. You are responsible for applicable taxes unless stated otherwise.

3. Pricing changes. Prices and available plans may change at any time to the extent allowed by law. If you have a subscription, see Section I.

4. Refunds. Refund eligibility depends on where you purchased. Platform purchases (e.g., iOS/Android) are handled by that marketplace under its rules. Direct purchases from us are refunded only where required by law or as stated in your purchase flow.

5. Fraud and abuse. We may refuse or reverse Transactions, or deny refunds, if we reasonably believe there is fraud, abuse, chargeback manipulation, policy violations, or unlawful activity.

1. Account optional/required. Some features may require an account. You agree to provide accurate information and keep it updated.

2. Security. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at info@apexbytetech.io if you suspect unauthorized use.

3. One person, one account. Unless we explicitly allow otherwise, you may not share your account credentials with others.

4. Account actions. We may suspend or terminate accounts as described in Section G.

1. Permitted use. You may use the Services for personal or internal business use unless your plan or the purchase flow states otherwise. You may not resell, rent, lease, or provide the Services as a bureau/service to third parties unless we explicitly authorize it in writing.

2. Prohibited conduct. You may not use the Services to violate any law or third-party rights; create, upload, or share content that is illegal, exploitative, or abusive; generate or distribute non-consensual sexual content, sexual content involving minors, or any content that sexualizes minors; generate or distribute deepfakes or impersonations that are deceptive, defamatory, or intended to mislead, scam, harass, or cause harm; or attempt to bypass safety systems, rate limits, access controls, or content filters.

3. Your responsibility. You are responsible for the content you upload or generate, obtaining all necessary rights/permissions from people appearing in images, and how you use outputs (including compliance with laws and platform rules).

1. Auto-renewal. Subscriptions may automatically renew unless cancelled before the renewal date.

2. Billing. Your payment method will be charged at the start of each subscription period (or as disclosed at purchase).

3. Cancellation. You can cancel in your platform account settings (e.g., App Store/Google Play) or as provided in your purchase flow. You retain access until the end of the current billing period unless required otherwise by law.

4. Trials. Free trials (if offered) may convert to paid subscriptions unless cancelled before the trial ends.

1. Outputs. The Services may generate edited images, enhancements, filters, transformations, or other results ("Outputs").

2. You are responsible for rights and permissions. You represent and warrant you have all rights to upload Inputs and to request the edits you request, including permissions from individuals depicted where required.

3. Safety systems. We may apply automated and/or human review, filtering, or blocking to prevent harmful content and enforce these terms.

1. Governing law. Except where prohibited by law, this Agreement is governed by the laws of the State of Florida, without regard to conflict-of-law rules.

2. Entire agreement. This Agreement (and any referenced policies) is the entire agreement between you and us regarding the Services.
